520 _a"Paterson v Humberside CC" QBD 28 February 1995. In 1990 a property, built on clay soil with 2 lime trees 9-10m from the frontage, began to crack, a problem identified as differential settlement in the foundations, caused possibly by the trees. In 1992, 20 more cracks were identified and by 1993 the house was reinforced by timber supports. An action by P against H seeking damages for nuisance and breach of duty under Highways Act 1980 s96, succeeded.
