Applicants (J) sought judicial review of SoS for the Environment`s (S) refusal to determine an appeal made by J against an enforcement notice alleging unauthorised use of land. S alleged notice of appeal made out of time and he had no power to extend the appeal period. The enforcement notice was to take effect on Monday 1 June 1987, unless an appeal was brought before then. J delivered the notice of appeal by hand on 1 June. S determined that the notice was served out of time; the last day of appealing being Sunday 31 May 1987. At issue was whether the appeal was made in time. Held that J could have served notice by posting documents through the letter box, even though there was no one in the building to receive them. The period for giving notice of appeal expired on 31 May 1987.
