520 _aIn R v Middlesbrough BC, ex parte Fortrees Ltd , QBD 16 December 1988, Fortrees Ltd offered to buy the freehold interest of surplus land owned by the Council. This offer was higher than a previous bid put forward by the Olympia Health and Fitness Club. The Council decided to proceed with the first offer; Fortrees objected, claiming that the Council had not complied with the Local Government Act 1972 s123 , because it did not accept the highest offer. Held that s123 places a statutory duty on the Council which they had failed to comply with.
