R reported favourably and M bought the house. Later another expert, G, foresaw further subsidence and recommended underpinning. M sought damages equal to the difference in value of the house in sound and unstable condition, but was granted £2 only on the grounds that though R was held negligent, no underpinning was required. M appealed and the judge concluded M was entitled to seek underpinning. Appeal allowed and £18,000 granted. | ||
