520 _aExamines two cases Pittalis v Grant (1989) (See Abstract 41122) and Maunsell v Olins (See Abstract 18466) which considered the rights of subtenants under Rent Act 1977 s137 (3) . In Pittalis it was held that a flat above a shop was not to be treated as a dwelling-house and in the Maunsell case a subtenant of a cottage forming part of an agricultural holding was not protected against the head landlord by the predecessor of s137 (3). Concludes with the view that the difficulties caused by s173 (3) should be eased by Housing Act 1988 .
