520 _aChD 27 October 1988 Application under Arbitration Act 1979 S2 by the lessors Ritz Hotel (R) for the determination of questions as to the true construction of a rent review clause contained in a lease . ChD held that where it is stated in a rent review clause that the hypothetical term is to be "a term equivalent to the term hereby granted" this means a term equivalent to the unexpired residue of the term originally granted, not a term commencing on the review date and being of the same length as the term originally granted. The court also gave guidance on assumptions to be made in rent review arbitration concerning casino premises.
