C submitted a planning application for an out-of-town supermarket and M for a town centre site, designated for development in a local plan. It was decided that Towcester needed only one new supermarket and SoS called-in M`s application for determination, refusing to also call-in C`s or to order a joint inquiry. HC quashed this decision and upheld applications by the council and M against the inspector in favour of C. SoS and C appealed. Appeal allowed.
