Application by (B) for judicial review in the form of a prohibition to restrain the respondents (C) from executing a general vesting declaration in pursuance of a compulsory purchase order in respect of 0.53 acres of land forming part of a car park to the Boars Head Hotel of which B is the owner. B claimed that the proposed exercise of power was in breach of natural justice. The cpo was made for the redevelopment of retail stores and an ancillary car park. The SoS appointed an inspector to conduct a public inquiry under Acquisition of Land Act 1981 , which held in favour of the scheme despite objections. B objected on the grounds that loss of their car park would seriously damage their business. The counterclaim against this was that the car park was not solely used by hotel customers; 50 spaces were rented to the South Wales Electricity Board. The developments went ahead and the hotel was forced out of business. The application did not however succeed because it wa
