| 520 | _aChD 28 February 1989. Action by M against H for possession of a 127- acre farm which was mainly arable . M was the freeholder of the land and H`s tenancy was a Lady Day tenancy (old style, April 6), the rent was payable half-yearly, in arrears, in October and April. There had been a recent history of rent arrears , reminders and notices culminating in events following the rent due in October 1986. A notice to pay rent under Case D(a) dated November 18 1986 required payment within two months from service of the notice. Payment of rent was not made until 6 February 1987. Accordingly a notice to quit was sent on 23 March 1987, terminating the tenancy on 6 April 1988. H claimed the notice had been temporarily misplaced which had caused the delay. Throughout the period M and their agents were in discussion with H who had financial difficulties. A critical meeting took place on 7 August 1987 at the request of H.
