A crofter on the island of Vatersay applied to the Court for an Order determining the status of an area of ground known as the housing area which she claimed formed part of their common grazings. The Court held that the evidence indicated that the share in the housing area let to each crofter was let as part of the crofts in the township. The shares could not be part of any individual`s croft land because they were not in individual occupancy but held in common with others and the Court therefore concluded that the housing area must form part of the common grazings let to the crofters.
