The appellant (C), having been refused planning permission by the local authority and SoS for an extension to a block of flats , claimed compensation under Town and Country Planning Act 1971 s169 and sched 8 para 3. The CA upheld the LT decision that the cost of rebuilding stronger walls to take the weight of the extension should be taken into account for compensation since the extension could not have been built without stronger walls .
