Subsequently D suggested alternative accommodation and embarked on proceedings for possession pursuant to s98(1) of the Act. Possession was granted to D at first instance as arrangements for repairing the building were held to be reasonable. B`s counterclaim for breach of repairing covenant was dismissed, as was the appeal.
