| 520 | _aQBD 17 October 1989 Two planning permission s were granted by Tower Hamlets for alterations to a building and change of use to B1 . Each permission was subject to a condition that "the building shall not be used, occupied or let otherwise than as 5 separate units". Appeal against these decisions and seeking to discharge conditions was dismissed by planning inspector. Applicant sought an order to quash that decision on the grounds, inter alia, that the inspector failed to identify whether any demonstrable harm would be caused by discharge of the condition and that he had not had proper regard to the guidance in DOE Circular 1/85 . QBD quashed the inspector`s decision. He had failed to give clear and intelligible reasons for setting aside a material consideration , namely the SoS`s advice in the circular. | ||
