520 _aQBD 16 January 1995. In 1981 the plaintiff (M) and the defendant (R) entered into a business lease. The lease was then assigned to X who ran into financial difficulties. X entered into a voluntary arangement with his creditors, including M. M sought payment of arrears from R. At the summons hearing, M`s claim was struck out on the grounds that the arrangement absolving X from liability also absolved R. M appealed. Appeal allowed. Judgment for the plaintiff.
