| 520 | _aCA 17 March 1994. W engaged R to design the sub-structure for factory units on a site at which the level had been raised by tipping. Starting in October 1980, 12 factory units were constructed pursuant to R`s recommendations that the buildings but not the floors should be piled. Two units were let to a tenant who subsequently complained the floors had settled. R investigated and issued a statement confirming the settling but that there would be no more. Settlement continued and the tenant had to be relocated. W issued a writ in 1990 and added amendments to the claim in 1992. Judgment allowed claims for breach of contract and for the remaining 10 units but did not allow a further claim against R for negligent misstatement. | ||
