520 _aHC 11 May 1994. Y engaged P as architects and F as contractors for the design and construction of hospital buildings in Bradford. In September 1992 Y issued a writ against F and P alleging defects in the buildings. F alleged there was a final certificate which provided a complete defence and thus Y pleaded a secondary cause of action against P for negligence. In 1990 the SoS established the buildings as an NHS trust and an agreement was made under which the rights and liabilities under the agreements with F and P were transferred from Y to the trust. Y applied to join the trust as a party to the proceedings to enable it to carry on with proceedings against F and P pursuant to RSC Order 15, r.7(2). Judgment allowed Y`s application.
