Action by M seeking recission of a contract signed at auction , return of a deposit of £49,000 and damages to cover conveyancing expenses thrown away, on the ground that they were induced to enter into the contract by a material misrepresentation for which A, vendors of three properties in North London were responsible. Rents from the three properties had been wrongly misrepresented at the auction as open to negotiation . ChD held that M had established their claim to the recission of the contract on the ground of material misrepresentation for which A were responsible. M were entitled to return of their deposit and damages in respect of lost conveyancing expenses with interest.
