At issue was whether, having served notice under Law of Property Act 1926 s146 on lessees in breach of repairing covenant , the lessors were required, at a later date, after accepting rent in the meantime, to serve a fresh s146 notice. The court held in favour of the lessors that they were entitled to possession without reissuing a notice as the breach of covenant had continued.
