520 _aThe "Waltham Forest LBC v Thomas" HL 18 June 1992 decision in allowing an appeal from the CA gives greater protection to individuals living with relatives wishing to succeed to the tenancy on the latter`s death. Held that according to conditions laid down in s87 of the Housing Act 1985 stating that although the successor must have resided with the deceased tenant during the period of 12 months ending the tenant`s death, the residence does not have to take place during the whole 12 months.
