520 _aIn "Neighbour and another v Baker and another" CA 5 June 1992, the CA upheld the plaintiff purchaser`s claim that the vendor was negligent by not making the details of the structural cracks known to him. However, the claim against the purchaser`s solicitors was dismissed on the grounds that they had advised their client to commission a structural survey before completion and that at the stage when the cracks were discovered had acted professionally in advising their client to continue with the sale, as this would almost certainly be the cheapest course of action.
