It was held that in order to pay creditors the selling of the matrimonial home , which would involve eviction of a wife and children, did not constitute an exceptional circumstance under Law of Property Act 1925 s30 , therefore the original proviso that the sale of the property should be postponed until the youngest child resident was 16 years old was changed to bring about the sale within 6 months.
