520 _a"Toplis v Green" CA 14 February 1992 concerned a dispute over a strip of land adjacent to property sold and the vendor farmers claim for trespass and damages. In dismissing the purchasers appeal alleging that the high court had wrongly allowed evidence extrinsic to plan, it was held that although the plan was not accurate it was annexed to the transfer and the purchasers had clearly seen where the boundary lay. the allegation of a breach of duty of care by the vendor was also dismissed.
