520 _aChD 22 February 1990 Application by council (W) for declarations that its powers of compulsory purchase had been exercised in respect of properties owned by Quereshi (Q), within the statutory period, that the relevant properities were vested in W and that W was entitled to take possession . The point at issue was whether compulsory purchase orders issued by W in 1984 had lapsed as the vesting declarations had not been executed within the three-year time-limit , from the date upon which the orders became operative, imposed by the Compulsory Purchase Act 1965 s4 , or whether W had exercised its compulsory purchase powers within the time limit by service of notices under Compulsory Purchase (Vesting Declarations) Act 1981 s3 . ChD held, allowing the application, that W`s powers of compulsory purchase were exercised within the statutory period from the date upon which the compulsory purchase orders became operative, by the service of s3 notices.
