An appeal, against a decision that a landowner on one side of a ditch had been in adverse possession of the ditch under Limitation Act 1939, was allowed. It was held that there was no evidence showing intention to exclude others from the property on the part of the plaintiff and his cleaning of the ditch was at the defendant`s request.
