The case Anns v Merton LBC (1978) AC 728 placed a responsibility on local authorities , in their supervision of compliance with the Building Regulations , to avoid damage to buildings which cause danger to owners` health and safety . This principle, having been challenged in 1989, has now been overturned by a House of Lords` decision in the case Murphy v Brentwood D C (26 July 1990) where it has been held that there is no liability in tort for the cost of averting a danger, whether of not the damage poses a threat to safety or health. | ||
