| 520 | _aCA 11 December 1990. The case in the lower court revolved around the applicability of the Landlord and Tenant Act 1954 s25 to the tenancy in dispute. The tenant (G) claimed that the tenancy was a protected residential one, so that the notice to quit served by the landlords (P) was null and void, and that she was protected by the Rent Act 1977 . The landlords, however, argued that the premises were being used for business purposes and so the 1954 Act should prevail. It was agreed that the outcome would be based on whether or not the tenancy was residential and the court found in the tenant`s favour. This decision was upheld later by the Court of Appeal and the appeal duly dismissed. | ||
