Appeal by plaintiff claimant from decision of LT concerning the relevant date, or dates, of assessment of compensation for the compulsory purchase of several parcels of farmland . The acquiring authority took physical possession of the land in eight separate stages between 5 June 1978 and 4 October 1980. LT decided that the eight various dates on which possession of the land was taken were the relevant dates for the purposes of valuation and the calculation of disturbance and interest on the purchase price. The claimant contended that LT was in error and that the relevant date of valuation for all purposes was the single date in June 1978 when the authority took possession of the first parcel of land. CA agreed with the claimant`s submission. CA held that the authority must be treated as taking possession at the date of the first entry, 5 June 1978, that being the relevant date for the assessment of compensation. Appeal allowed.
