Appeal by plaintiff authority against decision of SoS, who had declined to follow the recommendations of his Inspector and had granted outline planning permission for residential development on a green belt site. The difference of opinion related to conformity or otherwise between the Local Plan Policy HS1 and paragraph 8 of DoE Circular 15/84 Land for Housing. The Inspector concluded that the policy and the Circular were consistent, while the SoS opposed this view and branded the policy as one constituting the arbitrary rationing of land and inconsistent with Departmental advice. QBD upheld findings of SoS. Application dismissed. | ||
