520 _a"Camden LBC v McDonalds Restaurants Ltd" CA 5 October 1992. Local planning authority (C) appealled against HC`s declarations upholding (M)`s claim that planning permission originally granted in 1987 for the erection of a single storey extension with the groundfloor for use as a restaurant was still valid. The premises at 46 Hampstead High Street had been used as a restaurant between 1972 and 1987. Planning permission had been granted for a single storey extension on condition that the permission should be implemented within five years. Between 1988 and 1990 the premises were used for bookshop purposes. C declared that the permission had lapsed on the grounds that retail use under Class A1 for bookshop extinguished Class A3 use as a restaurant. Hc`s decision upheld. Appeal dismissed.
