520 _aIn "Midland Bank plc v Bardgrove Property Services Ltd and others" CA 18 June 1992, an appeal by the bank for damages to reclaim the cost of works from the defendants, (who had originally caused damage and subsidence to land) for restoring the land to its former state of stability, was dismissed . The present law required that actual damage was an essential feature of the cause of action, not just the threat of it.
