An application by T to purchase an apartment in a council hostel on the grounds that it was part of a dwelling house under the Tenants' Rights Etc (Scotland) Act 1980 s82. The tenant occupied the apartment primarily as a bedroom, other living activities such as eating and bathing were carried out in other parts of the hostel which were communal. G refused T`s application and he applied to the LT for an order under s3(4) of the Act finding that he had a right to purchase. Held that the apartment was not a separate dwelling under the terms of s10(1)(a) of the Act. T`s application refused. | ||
