The claimants sought compensation under Land Compensation Act 1961 s5 rule 5, which provides compensation to cover reinstatement cost when land would have continued in its existing use, for which there is no general demand, if the compulsory acquisition was not taking place. The tribunal found, however, that since the temple was in a clearance area, compensation was to be based on cleared site value as set out in Housing Act 1957 s59.
