It was held that the appellant (T) did not fulfil all the requirements to succeed his brother`s secure tenancy under Housing Act 1985 s87 not having resided for 12 months with the original tenant. T, although he had resided for two years with his brother, had moved with him to a new secure tenancy ten days before his brother`s death. South Northamptonshire DC v Power upheld. Appeal dismissed.
