_v9 April 1987, 12(1)
520 _aA discussion of a defect in the law on latent damages , in relation to limitation of actions , opened up in Pirelli General Cable Works Ltd v Oscar Faber and Partners , HL (Abstract 30748). where it was stated that perhaps there was a exceptional class of case "where the defect is so gross that the building is doomed from the start , and when the owners` cause of action will accrue as soon as the structure is built". This is generally known as the "doomed from the start" exception and is the source of continuing argument.
