520 _aIn "Spath Holme v Greater Manchester and Lancashire Rent Assessment Committee", CA 19 July 1995, it was held that when determining fair rents in respect of flats let on regulated tenancies a rent assessment committee erred in law in failing to appreciate that a fair rent was the market rent, and in concluding that assured tenancy rents for identical flats in the same block could not be used for comparables. Appeal by Greater Manchester Rent Committee dismissed.
