The lease on Orbit House has been assigned three times. M has paid no rent since Christmas 1991. Landlord Robert Maxwell Estates Ltd (RME) has issued writ to R to pay rent arrears. The underlease being registered land under the Land Registration Act 1925 implied a covenant under s24(1)(b) upon transferee at each assignment to pay the rent. R requested firstly that the administrators of MGH should assign the benefit of MG Newspaper`s covenant with MGH to pay rent to R, secondly an order directing the administrators of MGH to bring proceedings against MG Newspapers requiring it to pay rent to the landlord.
