An appeal by landlord (F) against a cc decision allowing the tenant (M) to serve a second notice concerning a reduction of the rateable value in preparation for acquiring the freehold of premises under the Leasehold Reform Act 1967. CA upheld the "Pollock v Brook Shepherd" principle that the timetable laid down in Housing ACt 1974 Sched 8 to facilitate a tenant to apply for the rateable value to be reduced in order to purchase the freehold under the Leasehold Reform Act 1967 was mandatory. Appeal allowed.
