This would be governed by the Local Government Act 1933, which required ministerial consent to the sale. The fact that such consent had not been obtained did not invalidate the option by virtue of provisions in Town and Country Planning Act 1959 s29. That the conveyance would take place after the introduction of Local Government Act 1972, which did not require ministerial consent, was not accepted.
