Appeal from CA which allowed an appeal by the council (H) from cc decision dismissing H`s claim for possession of property let to the appellant (M) and his cohabitee on a joint periodic tenancy terminable by four weeks notice, which notice had been duly served by M`s cohabitee without his knowledge or consent. Held that a contractual periodic tenancy held by two or more tenants continued only so long as both agreed to its continuation and that unless specifically treated in the agreement, such a tenancy can be terminated by a notice to quit from one party only, without the consent or knowledge of the other tenants. Appeal accordingly dismissed. | ||
