The council was not found to have been acting unreasonably in auction ing property after negotiating the leasehold or freehold with the appellants since all negotiations were subject to contract . Also the council was not acting contrary to Race Relations Act 1976 s71 in wanting to grant a long lease in preference to the freehold so as to enforce user covenants to restrict use to religious rather than community use .
