520 _a"Cresspark Ltd v Wymering Mansions Ltd" ChD 2 April 1996. Wymering Mansions purpose-built block of flats held on long leases. W was set up to acquire the freehold titles to the land. C and W entered into a contract in JCT standard form whereby C agreed to carry out major repair works to the building. W experienced cash flow problems and work stopped then recommenced after C agreed to readjust the works programme and accept delays in payment. W agreed to set up joint signatory banking arrangements to receive money from service charges and rent. C claimed an injunction to prevent W from dealing with funds except in accordance with supplementary agreement. W counterclaimed. Judgment for C.
