The appellants, having been convicted of felling trees without a felling licence contrary to Forestry Act 1967 s17, claimed that the burden of proof fell on the defendants to demonstrate that a licence was required. The defendants contended that the appellants had to prove that the felling of trees came within the exception to the requirement for a licence under s9 of the Act. Appeal dismissed.
