At issue was whether the regulations were flawed by reason of illegality in not giving effect to the European Commission approval in regard to new entrants to milk production. Held, that although the EC had increased the amount of quota available for certain categories of producers, and sought national measures of implementation from member states, the member state was not obliged to implement the approved proposals in full.
