An arbitration had been conducted under Agricultural Holdings Act 1986 and Agriculture Act 1986 between the two respondents, concerned with the assessment of compensation of termination of a tenancy. The arbitrator had sought an opinion as to whether a letter between the solicitors in November 1987 was sufficient notice for the purposes of the Acts. Slightly different notices are needed under the two acts both require notice in writing, it was to be given before the expiry of two months from the termination of the lease and the landlord was to be notified of the tenants intention to make the claim. However the Agricultural Holdings Act also requires that the notice should specify the nature of the tenants claim. It was held that the letter was a notice for the purposes of both Acts as the nature of the claim under Agricultural Holdings Act was implied by the notice under the Agriculture Act. | ||
