520 _aCA 5 December 1991. The respondent, the landlord N, was entitled to possession of the first floor of the property in question under the terms of a lease dated 1928. By an underlease of February 1981 the landlord demised the premises to the appellant for 20 years at an annual rent of £8,550. From September 1985 the rent was increased to £10,000pa. L also agreed to pay £1,350 +VAT pa representing a portion of insurance and sevice charges and they agreed not to assign the lease without N`s permission. In February 1982 L assigned the lease with N`s permission to another company and in July 1983 they in turn assigned it to S. In March 1986 the rent was not paid and in September N demanded the additional rent and 5% interest as agreed in the lease. N therefore began proceedings against S. In May 1988 the lease was assigned again in consideration of a payment of £22,000.
