520 _aQBD 14 June 1992. S alleged that the second defendant, the National Farmers` Union, was negligent in advice during a claim against the Dairy Produce Quota Tribunal. S`s challenge to the latter was for the loss of milk quota after his change of business partner, claiming exceptional hardship under the Dairy Produce Quota Regulations 1984. The NFU advised that a successful challenge could not be made. S, rejecting this advice claimed at court that the tribunal had erred and the advice was negligent. Held, the advice had not been negligent and the claim was dismissed.
