| 520 | _aHL 21 October 1993. A matrimonial home, valued at £270,000, had a mortgage against it of £16,700. The husband wished to borrow on the security of the house. He pursuaded his wife to sign for a loan of £150,000, which she did without advice or reading the documents. When the husband was unable to meet his mortgage payments C claimed possession. This the wife resisted on the grounds that she had been induced to sign under the undue influence of her husband and by misrepresentation. The judge agreed but as the husband was not the plaintiff`s agent the claim failed. P`s appeal was also dismissed and this decision upheld by the House of Lords. | ||
