520 _aQBD 20 December 1991. The plaintiffs (H) are dairy farmers. In 1983 they sought to expand and bought a farm not used for dairy farming for ten years. The move, delayed whilst new buildings were constructed, took place on 4 April 1984. On 31 March 1984 the European Community introduced milk quotas. In April 1984 H received a provisional assessment of primary milk quota based on their milk production at their previous farm in 1983. This belonged to the farm, not H. They could not obtain a quota on the new farm as there had been no production there. H made an exceptional hardship claim on the basis of special treatment for those in the middle of an expansion programme. At Tribunal this was dismissed after a ten minute hearing which H felt to be inadequate. Shortly after, H joined the NFU and details of the case were passed to a representative. The NFU advised that there was no immediate action to be taken but that they were taking a number of cases to court to establish precedence. Howe
