At issue was whether an action concerning the ownership of property in France was a matter of rights in rem in immoveable property, when under article 16(1) of the Brussels Convention on Jurisdiction and the Enforcement of Judgements in Civil and Commercial Matters 1968, the courts of the state, in which the property was located, would have jurisdiction. If the rights contested were derived from the contract between the parties the French courts would not have jurisdiction. Appeal adjourned and a request made to the European Court of Justice for interpretation of article 16(1).
