| 520 | _aChD (Companies Court) 5 February 1992. By a lease dated 19 June 1989 the tenant was granted a 20 year lease on premises. The applicant covenanted as surety to take a new lease for a term equal to the residue of the unexpired term of the lease in the event of the disclaimer of the lease by a liquidator. Following the tenants voluntary liquidation in July 1990 the liquidator disclaimed the lease in July 1991. Before the disclaimer the applicant parted with possession of the premises. The applicant paid a sum for rent and service charge due on 24 June 1991, which was accepted as mesne profits, and a further sum due on 29 September. By a letter dated 16 September the landlord required the applicant to take a new lease in accordance with its covenant. In January 1992 the landlord served a statutory demand for £12,527 representing rent and service charge till the end of December.
